This End User License Agreement ("EULA") governs your use of any software application ("App") published by DukeMade, LLC ("DukeMade," "we," or "us") through Apple's App Store or any other distribution platform. By installing or using any DukeMade App, you agree to be bound by this EULA.
Subject to the terms of this EULA and any applicable App Store terms, DukeMade grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices (iPhone, iPad, Mac, Apple Watch, or other Apple-branded devices) that you own or control, solely for your personal, non-commercial use.
You may not:
The App and all content, features, and functionality within it are owned by DukeMade, LLC or its licensors and are protected by applicable intellectual property laws. This EULA does not grant you any ownership rights in the App.
For Apps distributed through the Apple App Store, Apple is a third-party beneficiary of this EULA and may enforce its terms. Your use of the App must comply with Apple's applicable Usage Rules.
Our data collection and privacy practices for each App are described in the App's product page and the applicable Privacy Policy.
DukeMade warrants that the App will perform substantially as described in the App's official description. The App is provided "as is" without any other warranties. For support, contact us at hello@dukemade.com.
We reserve the right to modify or discontinue any App at any time, with or without notice. This EULA applies to all updates and modifications.
Your rights under this EULA will terminate automatically without notice if you breach any term. Upon termination, you must cease all use of the App and delete all copies from your devices.
You agree to indemnify and hold harmless DukeMade, its officers, and employees from any claims, damages, losses, or expenses arising out of your breach of this EULA or your use of the App.
To the fullest extent permitted by law, DukeMade shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use or inability to use any App.
This EULA shall be governed by the laws of the State of California, United States, without regard to conflict of law principles.
